Terms of Service

Welcome to OfferSecured. By accessing or using offersecured.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service

OfferSecured is a recruiting platform that helps high school student-athletes connect with college athletic programs. The Service provides tools for college search, coach contact information, recruiting activity tracking, AI-assisted message drafting, and athlete profile management.

2. Eligibility

• You must be at least 13 years old to create an account.
• Users under 16 must have parental consent to use the Service. A parent or legal guardian may create a linked parent account to monitor their athlete's recruiting activity.
• By creating an account, you represent that the information you provide is accurate and complete.

3. Account Types

The Service offers the following account types:

• Athlete: High school student-athletes building recruiting profiles and contacting college coaches.
• Coach:High school coaches monitoring their athletes' recruiting progress and providing guidance.
• Parent:Parents or guardians linked to an athlete's account to track recruiting activity.

4. User Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate information in your profile, including athletic measurements, academic records, and contact information.
• You will not use the Service to harass, spam, or send unsolicited messages to coaches beyond legitimate recruiting communication.
• You will comply with all applicable NCAA, NAIA, and conference rules regarding recruiting contact. The Service provides contact period information for guidance, but you are responsible for understanding and following applicable rules.

5. AI-Generated Content

The Service uses two separate artificial-intelligence providers to power different categories of features. See our Privacy Policy (Section 3) for a field-by-field description of what each provider receives. In summary:

• Google Gemini APIis used for features that process Google user data — Gmail-based conversation summaries, email draft generation, campaign drafts, and recruiting suggestions. Gmail content and substantive Gmail metadata are processed only by Google's Gemini API.
• xAI (Grok) API is used for features that do not involve Google user data — college search, school performance grounding, coach recommendations, X direct-message drafts, and questionnaire field mapping. Inputs to these calls are drawn from our own application database, from text you have entered, from summarised public X posts about college coaches, and from computed values. One narrow, disclosed exception applies to the X DM draft feature: the date on which a prior recruiting email event occurred may be included in the activity timeline sent to xAI as a date-only marker. xAI does not receive email content, subjects, sender or recipient identifiers, direction, thread IDs, Gmail labels, or any other Gmail content or substantive metadata.

You also acknowledge that:

• AI-generated content (such as draft messages to coaches) is provided as a suggestion only. You are responsible for reviewing, editing, and approving all content before sending it.
• AI-generated content may contain errors or inaccuracies. We do not guarantee the accuracy of AI outputs.
• You are solely responsible for any messages you send to coaches, whether drafted by AI or written manually.

6. Third-Party Services

The Service integrates with third-party platforms including Google (sign-in, Gmail, and the Gemini AI API), X (Twitter sign-in and linked account), and xAI (Grok AI API for the non-Gmail features listed in Section 5). Your use of these integrations is subject to each provider's terms of service. You may disconnect any third-party integration at any time via your account settings.

7. Intellectual Property

• You retain ownership of all content you create (profile information, messages, notes).
• You grant OfferSecured a limited license to use your content as necessary to provide the Service (e.g., displaying your public profile to coaches).
• The Service, its design, and its underlying technology are owned by OfferSecured.

8. Prohibited Conduct

• Scraping, crawling, or automated access to the Service without written permission.
• Impersonating another person, coach, or institution.
• Using the Service for any unlawful purpose or to violate any applicable law or regulation.
• Attempting to gain unauthorized access to other users' accounts or data.
• Interfering with the proper operation of the Service.

9. Disclaimers

• The Service is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee that use of the Service will result in college recruitment, offers, or scholarships.
• Coach contact information, school data, and NCAA rules information are provided for convenience and may not always be current. Verify important information independently.

10. Limitation of Liability

To the maximum extent permitted by law, OfferSecured shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Account Termination

You may delete your account at any time by contacting us. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
